Attorney General of Ghana, Mr. Godfred Yeboah Dame has eventually filed an appeal at the Supreme Court seeking to overturn the ruling by an Appeal Court which ruling discharged and acquitted Ato Forson and Richard Jakpa.
The attorney general of Ghana vowed to appeal the ruling which he described as unfair and erroneous and had same remarks criticized by the judiciary.

The ruling was adjudicated by justices off the court with a ruling by a 2:1 ratio of the justices.
The previous order from the trial High Court, required Dr. Ato Forson and Mr. Jakpa to present their defense.
The charges against Dr. Ato Forson and Mr. Jakpa involved allegations of causing a financial loss of €2.37 million to the State in a deal to procure ambulances for the Government of Ghana.
The Court of Appeal’s decision overturned the directive from Justice Afia Serwaa Asare Botwe of the trial High Court, which had dismissed Dr. Ato Forson’s submission of no case and ordered him to open his defense.
Dr. Ato Forson had argued that there was no case for him to answer, but this submission was initially rejected by the trial judge.
Some NDC members have maintained that the Attorney General have lost the case and persistence will yield no results especially when Ghanaians and the judiciary have witnessed how he misconducted himself and the leaked tape was admitted in evidence against him.
